Well the Marina can''t guarantee that my transom won't stay sealed they did a qhote for G-Flex Epoxy for along the seam of the back of the boat. The original gasket is leaking. Also will fabricate the top rail and weld the bottom Gusset. Not sure what to tell the Ins. Com. They want to repair the Transom for 500 Bucks. I went ahead and bought another boat Upgraded to a 16 ' Ultracraft Canadian boat made in Iowa. Weighs twice as Much as my Lowe 1457. Will probably retire or scrap the Lowe Just want to get a fair deal from the Ins.

Well I think you have a couple options.
1. keep saying no, until you get somewhere...
2. Get a arbitrator.
3. Go through your insurance, and let them deal with it, that's what you pay them for.
4. Option take them to court, not sure it's cost effictive unless you can win.

Get a statement in writing from the Marina that the work cannot be gauranteed and why.It probably means the boat is actually a total. Sounds like the boat would be unsafe. Then forward the statement to the insurance co. telling them that an ungauranteed repair is unacceptable and you will not settle. Push for a total and a cash settlement equal to the fair current value of the rig. You may have to do some legwork yourself,to figure what that value is,so you know what you should settle for. Then let THEM scrap the boat.

I had a similar problem. In May I had my CMC PT 35 break on my Alumacraft Trophy 200. The 9.9 kicker beat the transom for over 3 hours while I was towed back in. The insurance company stated that they would pay to have a plate welded to the transom but when I called Alumacraft they said the boat was total. After 65 days of fighting the insurance company they paid for a marine surveyor that reported back to them that the boat was indeed totaled. Everyone, except the insurance adjuster saw the ripples in the transom, the 200 had been lifted by over a ½”, and the top cap on the transom broken in half. The insurance company finally has issued a settlement check that I accepted. Don't give up. I will take time to get the proper settlement but it is worth it!
