ND state sueing Corp. of Engineers?

Can anyone shed some light on the news that the state of ND is sueing the Army Corp. of Enigeers for the management plan for the Missouri River system? To my knowledge, the state is sueing the Corp. for plans that were supposed to be in place now and they've been waiting for over 13 years, and now the Corp. says that they never will get them. Input?
