Default Liability question

Anyone know if your vehicle is tow rated for 2000 pounds and your boat/motor/trailer/gear weigh 2300 - and you are in an accident...are you almost automatically at fault with higher penalties?

I think the big issue would be the civil suit that is likely to follow. Then a good attorney will put your butt in a big $$$$$$ sling.
